NYC Congestion Pricing: A Judge's Decision Could Halt the Weekend Launch!

Will New York City's congestion pricing plan, set to begin this weekend, be put on hold? A federal judge's ruling is expected to determine the fate of the controversial tolling plan affecting Manhattan below 60th street.

The Legal Battle

A New Jersey lawsuit challenged the congestion pricing plan, leading to a tense court hearing. Attorneys representing New Jersey argued that the plan should be temporarily halted, while New York maintained that it should proceed as planned. The judge heard arguments from both sides, creating a period of uncertainty.

The initial judge's ruling created confusion, with both sides claiming victory. The ruling stated that regulators needed to clarify how much money New Jersey communities would receive to mitigate pollution. Crucially, it didn't explicitly halt the implementation of the tolling plan.

Conflicting Statements

The MTA Chair and CEO, Janno Lieber, declared that congestion pricing would start as planned, despite the judge's partial ruling in favor of the delay. However, New Jersey attorneys argued that the MTA could not proceed due to the judge's order to the Federal Highway Administration (FHWA) to provide additional data on pollution mitigation.

The Stakes

If the judge sides with New Jersey, New York could appeal, but time is short. A delay could have major consequences, potentially killing the congestion pricing plan entirely. The plan, with a revised $9 toll for E-ZPass users during peak hours, aims to reduce traffic congestion and fund public transportation improvements.

How Congestion Pricing Would Work

The plan would impose a daily toll of $9 (E-ZPass) during peak hours (5 a.m. to 9 p.m., Monday-Friday) to drive into Manhattan below 60th street. There are exemptions for emergency and government vehicles, school and commuter buses, and for certain low-income drivers and individuals with medical conditions.
